3. Purpose for the proposed rules and background:  
These rules implement provisions of the Debt Management Act, MCL 451.411 et seq. (DMA). The  
proposed amendments reflect changes necessitated by the amendment of the DMA by PA 362 of  
2014, effective March 16, 2015.  
4. Summary of proposed rules:  
The proposed rules are being amended to reflect changes in the Debt Management Act, MCL 451, et  
seq. (DMA) by PA 362 of 2014, effective March 16, 2015. The proposed rules are intended to provide  
clarity to regulatory requirements set forth in the DMA. The proposed rule set eliminates obsolete  
terminology and regulatory requirements that conflict with the DMA while adding clarifying  
terminology and requirements. It will also provide regulated entities clarity with regard to  
implementing business practices to comply with the regulatory requirements set forth in the DMA.

The public hearing was initially scheduled to occur in person on February 12, 2020. However, all  
DTMB-managed buildings were closed due to loss of heat on that date. The public hearing was  
rescheduled to occur March 27, 2020. On March 10, 2020, Governor Whitmer issued Executive  
Order 2020-04, which declared a state of emergency across the State of Michigan due to the COVID-  
19 pandemic. On March 23, 2020, Governor Whitmer issued Executive Order 2020-21, directing  
Michigan residents to remain at home or in their place of residence, with limited exceptions. Pursuant  
to the aforementioned Executive Orders, DIFS issued Bulletin 2020-07-CF on March 25, 2020, which  
served as notice that, in lieu of holding the in-person hearing on March 27, 2020, the time for written  
public comment was extended to April 3, 2020, and the comments would be received via e-mail to  
Mark Weigold, Assistant Director, Office of Consumer Finance. Bulletin 2020-07-CF was uploaded  
in the Final Rule portion in ARS.
