3. Purpose for the proposed rules and background:  
The Real Estate Brokers and Salesperson General Rules pertain to licensure and license renewal for  
real estate brokers and salespersons and establish requirements for schools offering prelicensure  
educational programs. The current rules lack criteria regarding the courses approved for prelicensure  
education. The rules will be revised to establish the criteria for prelicensure courses and will also be  
revised to update and amend outdated information and provide clarity.  
4. Summary of proposed rules:  
The proposed rules add and amend definitions; clarify required prelicensure education and experience  
requirements; clarify the impact on the license of a real estate salesperson or an associate real estate  
broker when the affiliated broker’s dies or becomes disabled; clarify the licensee’s duties pertaining  
to service agreements, delivery of an offer or acceptance, trust and escrow accounts, and licensee  
commissions; clarify prelicensure and continuing education requirements; and clarify a real estate  
school’s duties related to its students and a student’s records.
