The Department of Licensing and Regulatory Affairs will hold a public hearing to receive public  
comments on proposed changes to the Pharmacy – Program for Utilization of Unused Prescription  
Drugs rule set.  
The proposed rules include the following modifications: update the rules; allow drugs that include a USP-  
recognized method to detect improper temperature variations in the donation packaging; after two years  
allow an electronic duplicate of an original record; update the requirements for donated prescription  
drugs; delete the form required by a resident of an eligible facility; allow forms similar to the department  
forms to be used by participants; allow a pharmacy to repackage donated medications; and modify the  
requirements for a handling fee.  
By authority conferred on the director of the department of licensing and regulatory affairs and board of  
pharmacy sections 16145, 17701, and 17775 of the public health code, 1978 PA 368, MCL 333.16145,  
333.17701, and 333.17775 and Executive Reorganization Order Nos. 1991-9, 1996-2, 2003-1, and 2011  
-4, MCL 338.3501, 445.2001, 445.2011, and MCL 445.2030.  
The proposed rules will take effect immediately after filing with the Secretary of State. The proposed  
issue of the Michigan Register. Copies of these proposed rules may also be obtained by mail or
