7. Describe the general purpose of these rules, including any problems the changes are intended
to address.
This rule regulates watercraft in a specific area or body of water where statute is not adequately
detailed to address safety issues.
8. Please cite the specific promulgation authority for the rules (i.e. department director,
commission, board, etc.).
The Department has authority to promulgate and enforce administrative rules to implement Part
801 of NREPA as provided in MCL 324.80121 and MCL 324.80113.

RFR-Page 2
This rule is being replaced with a local watercraft control established by MCL 324.80110-12a;
therefore, this older rule is obsolete and no longer necessary because it duplicates the regulation
promulgated more recently.
10. Is the subject matter of the rules currently contained in any guideline, handbook, manual,
instructional bulletin, form with instructions, or operational memoranda?
This rule was posted on the DNR Website under “controls by county”; however, it has been
replaced with a new LWC, and is therefore obsolete. The website will be updated to reflect this
change in regulations.
11. Are the rules listed on the department’s annual regulatory plan as rules to be processed
for the current year?
No.
12. Will the proposed rules be promulgated under Section 44 of the Administrative Procedures
Act, 1969 PA 306, MCL 24.244, or under the full rulemaking process?
MCL 24.244 (1)
A. Explain why the rules are being promulgated under 24.244.
The rescission is being processed under MCL 24.244 because it is exclusively a rescission of a
rule that is obsolete.
MCL 24.239
