7. Describe the general purpose of these rules, including any problems the changes are intended  
to address.  
One purpose of the rules is to delete language about family and consumer science programs and  
parent education because the authorizing statute, section 61a of the state school aid act of 1979,  
MCL 388.1661a, was amended by 2010 PA 110, effective October 1, 2010, to remove authority to  
promulgate rules about those programs. Another purpose is to align the rules with the 2018  
amendments of the strengthening career and technical education for the 21st century act (Perkins V),  
20 USC 2301 to 2414. Statutory, rule, and federal regulation references are updated, unnecessary  
and obsolete language is deleted, and other amendments conform the rules to Administrative Rules  
in Michigan: A Manual of Style (June 2023). The reference to items being “adopted by reference” is  
deleted as in conflict with MCL 24.232(4) and the style manual.

rules.

The rules do not conflict with or duplicate similar rules, compliance requirements, or other standards  
adopted at the regional or federal level. R 395.281 conflicts with MCL 24.232(4) and Administrative  
Rules in Michigan: A Manual of Style (June 2023) regarding adoption by reference.

of 1969, 1969 PA 306, MCL 24.244, or under the full rulemaking process?

A. Explain why the rules are being promulgated under 24.244.  
The proposed rules will be promulgated under section 44 of the Administrative Procedures Act  
of 1969, 1969 PA 306, MCL 24.244, because the proposed changes are necessary to align  
with the 2010 amendment of section 61a of the state school aid act of 1979, MCL 388.1661a,  
and with the strengthening career and technical education act (Perkins V), 20 USC 2301 to  
2414; and to accomplish the purely formal purposes of updating statutory, rule, and federal  
regulation citations and aligning the rules with Administrative Rules in Michigan: A Manual of  
Style (June 2023). The reference to adoption by reference is deleted as in conflict with MCL  
24.232(4) and the style manual. Obvious errors are corrected, and the term “capstone” is  
deleted because it is obsolete and meaningless.  
Based on the information provided in this RFR, MOAHR concludes that there are sufficient policy and legal  
bases for approving the RFR. The RFR satisfies the requirements of the administrative procedures act of  
1969, 1969 PA 306, MCL 24.201 to 24.328, and Executive Reorganization Order No. 2019-1, MCL 324.99923.
