7. Describe the general purpose of these rules, including any problems the changes are intended  
to address.  
The purpose of these rules is to regulate campaign finance. The specific purpose of the rules that are  
the subject of this RFR is to regulate the state campaign fund. The amendment to these rules seeks  
to rescind all the rules in Part 4 of the current Campaign Financing rule set and split them into a new  
rule set addressing the state campaign fund. This new rule set will be added in a separate, full  
rulemaking transaction. The overall goal of this effort is to modernize the department's campaign  
finance rules and to make them easier to navigate by splitting them into rule sets addressing discrete  
topics.

Yes, MCL 169.215(1) provides: The secretary of state shall do all of the following: (e)  
Promulgate rules and issue declaratory rulings to implement this act in accordance with the  
administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.

Yes, the state campaign fund and campaign finance complaints and investigations are addressed in  
department manuals, instructions, and forms as well as operational memoranda.  
11. Are the rules listed on the department’s annual regulatory plan as rules to be processed for  
the current year?  
No.  
12. Will the proposed rules be promulgated under Section 44 of the administrative procedures act  
of 1969, 1969 PA 306, MCL 24.244, or under the full rulemaking process?

A. Explain why the rules are being promulgated under 24.244.  
The purpose of this rulemaking transaction is to rescind part 4 of the existing campaign  
financing rules because that part is being promulgated as new, standalone ruleset in separate  
transactions; specifically, in 2026-10 ST. Part 4 needs to be rescinded from this existing rule  
set because the rules in Part 4 will be obsolete when the new, updated standalone rule set is  
promulgated.  
Based on the information provided in this RFR, MOAHR concludes that there are sufficient policy and legal  
bases for approving the RFR. The RFR satisfies the requirements of the administrative procedures act of  
1969, 1969 PA 306, MCL 24.201 to 24.328, and Executive Reorganization Order No. 2019-1, MCL 324.99923.
