>> Laura: Good evening. We appreciate the opportunity to provide public comment. And this comment  
is in regard to the change of the participants for IEP development for students who are placed in an  
operating district. We want to go on record as Grand Rapids Public Schools as stating that this is a  
positive interpretation. It returns the due diligence to the resident and operating district for ongoing  
communication and collaboration to be in service to students and still provides high rigor and  
expectations for student progress.  
We appreciate the Department's looking closely at the comments for the previous rule change and for  
taking the opportunity to make the required adjustments to right that previous action to stabilize the  
system and to still keep compliance in place for kids.

EVALUATION IS HELPFUL THE ADDITION OF CRITERIA, REGARDING ADVERSE EDUCATIONAL  
PERFORMANCE WOULD PROVIDE TEAMS WITH ASSISTANCE FOR ELIGIBILITY.  
THE PROPOSED CHANGES, WILL INCREASE, THE VI TEACHER CONSULTANT OREGON ENATION MOBILITY  
SPECIAL CASE CASE LOAD AND INCREASE IN STUDENT'S WITH A SHORTAGE OF QUALIFIED STAFF IN THIS  
AREA, IN MICHIGAN, WILL RESULT IN THE SIGNIFICANT INCREASE. IN FINANCIAL LIABILITY FOR SCHOOL  
DISTRICTS.  
TO MEET THIS NEED -- AND -- WITH REGARD, TO THE PROPOSED CHANGES, FOR 1721E I AM IN  
SUPPORT OF THE PROPOSED CHANGES, I WOULD LIKE TO RECOMMEND ADDITIONAL GUIDANCE FROM  
THE OFFICE OF SPECIAL EDUCATION, WITH REGARD TO THE RESIDENT DISTRICT RESPONSIBLITY FOR THE  
OFFER OF A FREE, APPROPRIATE PUBLIC EDUCATION. AND AS THAT IS TYPICALLY ASSOCIATED WITH THE  
ATTENDANCE AT THE IEP MEETING.

I HAVE A COUPLE OF CONCERNS THAT REALLY JUMP OUT AT ME ABOUT THE CHANGES PROPOSED  
CHANGES I JUST WANTED TO ADDRESS THOSE. THE FIRST WOULD BE, UM, THE REMOVAL OF THE  
DETERIORATING EYE CONDITION AS A ONE OF THE WEES THAT A CHILD COULD BE ELIGIBLE AS A VAI,

WITH A IMPAIRMENT. AND THE REASON I SAY THAT IS BECAUSE, THE WAY THAT THE NEW RULE WOULD  
BE WRITTEN, TALKS ABOUT IT HAVING AN IMPACT ON THE EDUCATIONAL PERFORMANCE.  
SO, IF WE HAVE A STUDENT WITH A PROGRESSIVE DETERIORATING EYE CONDITION LIKE RP, FOR  
RETINITIS PIGMATOSA, THAT STUDENT COULD HAVE GOOD VISION RIGHT NOW BUT COULD LOOSE  
THAT BEFORE LEAVING PUBLIC EDUCATION. PEOPLE LIKE ME WOULD BE TEACHING BRAILLE AND  
ASSISTIVE TECHNOLOGY ALONG DURING THEIR EDUCATION. TO PREPARE THEM FOR THAT MOMENT.  
SO, FOR THOSE KIDS, UM, AND STUDENTS THAT MAY HAVE A DETERIORATING CONDITION, THIS DOES  
YOU KNOW, HAVE AN IMPACT THERE, BECAUSE THEY'RE GOING TO LOOSE OUT ON THAT. WE WOULD  
HEIGHT FOR THEM TO LEAVE PUBLIC EDUCATION KNOWING AT SOME POINT THEY'RE GOING LOOSE  
SIGHT NOT BE PREPARED FOR THAT. SO, THAT'S MY FIRST CONCERN.  
THE OTHER CONDITION THAT I HAVE IS, THE -- THE LANGUAGE THAT IS CHANGING IT TO MUST INCLUDE  
ALL OF THE FOLLOWING. IT SAYS EYE REPORT FROM AN O PH TMOLOGJIST OR OPTOMETRIST IS THIS  
LEADS TO INHE CAN WETTITIES WE HAVE MANY STUDENTS, IN OUR STATE, THAT DON'T HAVE THAT  
ACCESS TO THOSE DOCTORS. OR DON'T HAVE THE MEANS TO GET THERE, DON'T HAVE, THE COVERAGE  
OR THE WHERE WITH ALL TO GET THAT. TO GET THAT REPORT PRIOR TO COMING IN, TO THE  
EDUCATION SYSTEM, TO GET AN IEP EVALUATION. AND SO, YOU KNOW MANY TIMES WE'LL DO A  
FUNCTIONAL VISION EVALUATION, WHICH IS INCLUDED IN THE NEW WORDING.  
BUT IT WILL BE HELPFUL IF IT WAS WORDED TO SAY, IF THAT DR. REPORT IS NOT AVAILABLE PRIOR TO  
EVALUATING THAT WILL FUNCTIONAL VISION EVALUATION BY THE TEACHER CONSULTANT FOR THE  
VISUALLY IMPAIRED WOULD BE ACCEPTABLE IN ORDER TO, UM, YOU KNOW MAKE THAT STUDENT  
ELIGIBLE WITH THE VISUAL IMPAIRMENT.

IMPORTANT EARLY INTERVENTION IS AND WHEN SPEAKING ABOUT THE EYE REPORT THERE'S MANY  
MANY, MANY INFANTS AND BABIES WE GET WHERE THE DOCTOR SIMPLY REPORTS CANNOT BE TESTED.  
THE REASON THAT THEY CAN'T BE TESTED IS MANY OF THEM, WOULD ONLY BE ABLE TO BE REALLY  
LOOKED AT UNDER'S I CAN'T. ANES TESHIA CAN LOOK AT THE BACK OF THE EYE AND DON'T HAVE A  
DIAGNOSIS YET. ALLOWING THE FUNCTIONAL VISION REPORT, TO BE -- OR EVALUATION TO BE DONE BY  
A, TEACHER OF THE VISUALLY IMPAIRED OFTEN, ALLOWS US TO GO YOU KNOW OPEN THAT DOOR. AND  
THEN, UM, HAVE THE INFANT OR CHILD BE SEEN BY SOMEBODY THAT DOES A MORE, A MORE  
APPROPRIATE EVALUATION BASED ON THAT AGE.  
IF WE TAKE THAT OUT, WHERE YOU KNOW, THAT WE MUST HAVE THAT EYE REPORT AND WE DON'T  
ALLOW THE FUNCTIONAL VISION EVALUATION TO BE PART OF THAT INSTEAD IF THEY'RE ABLE TO  
OBTAIN ACUITY AND THOSE INFANTS AND YOUNG CHILDREN OFTEN HAVE TO WAIT UNTIL THEIR LIKE 3-  
5 OR SOMETIMES, MANY TIMES 5.

BROUGHT UP ABOUT THE PROGRESSIVE IMPAIRMENT WHICH I HAVE BEEN IN THIS FIELD FOR 30 YEARS I  
DON'T CLAIM AT ALL TO KNOW EVERYTHING. BUT IN MY 30 YEARS, I WOULD SAY ON MY CASE LOAD  
EVERY YEAR, AT LEAST 20-25 KIDS. WE'VE HAD STUDENTS WITH RETINITIS PIGMATOSA, IS A  
PROGRESSIVE DISEASE IT IS IF IT'S GOING LEAD TO BLINDNESS IT IS WHEN.

THERE'S 2210 TIMES FOMPLE OF IT. MANY TIMES THESE ARE STUDENTS ARE AT GRADE LEVEL. THEY  
COME INTO A EARLY INTERVENTION OR PRESCHOOL, DON'T SHOW ANY IMPACT. THEY DON'T SHOW  
ANY IMPACT BECAUSE THE PART OF THEIR EYE THAT, IS GOING TO BE DAMAGED, UM, BEYOND REPAIR  
IS NOT SHOWING THOSE SIGNS YET. OFTEN THESE KIDS ARE NOT EVEN DIAGNOSED UNLESS THEY HAVE  
GENETIC TESTING. UNTIL, THEY START TO TRIP AND FALL OR THEY CAN'T SEE AT ALL AT NIGHT.  
THAT IS USUALLY PRETTY EARLY. BUT THEN THAT'S THE ONLY THING THAT'S THE IMPACT FROM. SO  
WHEN -- WHEN WE DON'T, WHEN WE CAN'T GET ENTRANCE TO THAT, WHAT WE FIND IS, I'M NOT JUST  
SAYING THIS, MANY OF THE STUDENTS THAT WE HAVE LATER COME BACK TO US AND SAY, I WOULD  
NOT HAVE BEEN ABLE TO GET THROUGH TAKING NOTES WITHOUT KNOWING BRAILLE.  
EVEN THOUGH, I THOUGHT I'M LEARNING THE WHOLE CODE, TO TAKE AWAY THAT A PROGRESSIVE  
THAT DELINEATION, EVEN THOUGH VISUAL IMPAIRMENT IS LOW INCIDENCE THAT PARTICULAR  
POPULATION, OF PROGRESSIVE IMPAIRMENT WOULD LEAVE US NO ALTERNATIVE UNLESS THEY HAVE  
ANOTHER DEFINING IMPAIRMENT WITH RP, OFTEN THAT IS JUST IT.  
WE HAVE A STUDENT, I HAVE A STUDENT RIGHT NOW, AND MY COLLEAGUE HAS A STUDENT HE IS IN  
MEDICAL SCHOOL AT WAYNE STATE, HIS DID NOT PROGRESS UNTIL HE WAS AT UNIVERSITY OF  
MICHIGAN. HAD WE NOT BEEN ABLE TO TEACH HIM TECHNOLOGY. EXPLORE SCREEN READERS ALL OF  
THAT, HE WOULD BE TRYING TO LEARN THAT WHILE HE IS IN A VERY -- PROGRESSIVE EDUCATION  
PROGRAM. SO THE PROGRESSIVE NATURE IS REALLY IMPORTANT FOR THOSE KINDS OF STUDENTS.  
OBVIOUSLY, UM, THERE ARE MANY DISTRICTS THAT YOU KNOW, UM, CANNOT DO ANY SPECIALIZED  
SKILL UNDER A 504. THAT'S NOT WHAT A 504 IS. IT'S NOT ABOUT ACCOMMODATIONS AT THIS POINT.
